What is a Gwen's Law Hearing?

A Gwen's Law hearing is a specific type of hearing in Louisiana that deals with domestic violence cases. It is named after a woman named Gwen Cox, who was tragically killed by her estranged husband in 2005, even though he had a history of domestic violence.

In Louisiana, if a person has been charged with a domestic violence-related offense and wants to get a bond set and be released from jail before trial, that person must go through a Gwen's Law hearing. This hearing is held to determine whether or not bail or bond should be granted, and, if so, under what conditions.

The state takes domestic violence cases very seriously to ensure the safety of the alleged victim and prevent any potential harm to the victim and/or the public. So, this additional hearing is required to assess the risk the defendant may pose if released on bond. The court will consider various factors, such as the severity of the alleged offense, past criminal history, and the likelihood of being a danger to the alleged victim or the community.
